California: Intoxicated Tourist Raped in Guest Room

On Wednesday (December 5), Henry Tito Palacios, 35, of Napa, CA agreed to plead no contest to rape and burglary for the March 2012 incident at the River Terrace Inn on Soscol Avenue in Napa. Note: A no contest plea in effect is treated as a guilty plea at sentencing.

Palacios, who formerly was employed as a bartender at the River Terrace Inn in Napa will spend 52 months in state prison after reaching a plea agreement with prosecutors. Additionally, he will be required to register as a sex offender. 

Severely intoxicated, when the victim awoke in her guest room, Palacios was on top of her and forced her to have sex against her will.

Palacios remains in custody at the Napa County Jail.

COMMENT: There are several lessons to be learned from the victim's being attacked: 

1. When traveling, particularly alone, drink in moderation, as not doing so renders you very vulnerable to violent crime;

2. Thoroughly engage a guest room deadbolt lock and all secondary locks that can prevent would-be assailants from entering your room;

3. When returning to your guest room, be observant of those around you, particularly those that might be following you to your room; and

4. Being severely intoxicated can inhibit a would-be victim's ability to resist, scream and/or escape, particularly if the assailant is not armed.
